Called to Order:  7:30 PM under the M.G.L. chapter 131, s.40 and the Hanson By-Law 1-13 s.5.  by Arthur Gelsi, Chairman

Public Hearings

7:30 PM  Continued Request for Determination (RDA) After the Fact for Old Road, Map 39, Lot 32A, repaving of driveway with Catherine Kuchinski being represented by Marta J. Nover, L.S.P. of Nover-Armstrong Assoc., Inc., 124 Main St., Unit 2GG, Carver, MA  02330

Ms. Nover presented stamped & dated, colored plans depicting a re-established wetland line that was last shown on a map in 1990.   Also, the wetlands had been flagged and numbered.  She  presented a letter itemizing field data of the areas that are on Ms. Kuchinski’s property. Mr. Grattan commented that if this were an  RDA, a request for hay bales would have been made.

Mr. Gelsi asked for comments.  Mr. John Aiello asked if the flagging and numbering had been depicted on the map.  Ms. Nover replied no and asked that any decision being made should be based on site inspections and the updated map.  

Mr. Aiello stated for the record that even though the driveway is an enhancement, it’s a future plan and it should be accurate.  If the Board goes that route, it has to with everyone.  It is clearly stated in the regulations that the plan should indicate the flagging and numbering.

Mr. Grattan asked if Ms. Nover could note the flagging on the map.  She said yes, but it would be approximate, plus or minus ten feet.  Ms. Nover added that if this were a filing for a Notice of Intent, the flagging should be accurate.    Ms. Cassady wanted the initials of the flagger to be  on the flags.  Ms. Nover said she will do.

Mrs. McKeen thought that it would create undue hardship on the applicant to insist upon flagging and numbering the map as it would be an additional surveying cost.  However, we are

setting a precedent and we should follow the same should we encounter a  similar Request for Determination.

8:00 PM  Continued NOI , construction of a single family dwelling for Lot 18, W. Washington St. with Mr. Frank Harbester.

This hearing was canceled by a request from Mr. Harbester and rescheduled for July 22nd at 8:30 PM.


8:30 PM  Informal Meeting with Tetratech F.W. (Foster Wheeler Environmental Corp., 133 Federal St., 6th Floor, Boston, MA  02110)  Factory Pond sampling with Boyd Allen III, CPG, Project Manager.  

Mr. Allen made a presentation in regards to the Phase II Comprehensive Site Assessment that was done at the former fireworks facility located on the Hanson/Hanover line (Factory Pond and Indian Head River) in accordance with the Massachusetts Dept. of Environmental Protection (MADEP) which classified the Site as Tier 1A in 1998.  Mr. Allen maintained that the soil and sediment samplings that were done were to determine human health risk assessment and ecological ramifications.   He then described the types and locations of the testing.  All testing had to be negotiated with access agreements with abutters.   

Mr. Allen passed out a press release from the DEP announcing a Public Meeting to be held in Hanover Town Hall on June 30, 2003 where a presentation of the Phase IID Scope of Work that will be implemented during the summer and fall of 2003 will be discussed.    He also presented the proposal with an updated fact sheet.   The Board thanked Mr. Allen for his presentation.
 
9:00 PM  Formal Meeting with Ken Sweezey regarding the reconstruction of his driveway, 51 Mattakeesett Street.

A certified letter was sent to Mr. Sweezey asking him to attend this meeting to discuss the paving of his driveway across wetlands after another scheduled meeting of June 3 was verbally cancelled by him.  He did not appear for this meeting either.

Motion to send letter to Mr. Sweezey notifying him that a fine of $100 per day will be instituted against him beginning July 8th  for not responding to the Conservation Commission and possibly altering wetlands:  Mr. Grattan

Discussions

1.      Ms. Kuchinski, Selectman, mentioned that we need to appoint someone to the Drainage Commission.  Mr. Grattan volunteered.  Peter Jones, Selectman asked for a vote.

2.      Mr. Gelsi asked Peter Jones about the LiteControl property.  It’s about 4-5 acres and the Board is interested in acquiring it for conservation land.  Mr. Jones will look into it.
3.      Mr. Gelsi  asked Mr. Jones about the installation of a plaque for the conservation land located off County Rd. and W. Washington Streets (Map 92, Lot 23).   Also, would the selectmen consider donating some town owned land to Conservation for access to the aforementioned conservation land.   Mr. Jones said when the Board decides where they want the plaque to write a letter to the Selectman.
4.      Ms. Lila Coyle of the Zoning Bd. Of Appeals came before the Board to inform them that they will send a letter to the owner of 181 Franklin St. regarding access to the property.
5.      Mrs. McKeen expressed concerns about her capacity to continue to serve on the Board citing health issues.

Signing of Special Orders of Conditions

1.  An Order of Conditions for construction of an addition to an existing dwelling on 153 Wagon Trail, Map 120, Lot 56, owner Mark Modestino  DEP #175-397 with special conditions:  
·       Proposed stairs allowed within the 50-ft. no disturb zone but no other work shall be done within the 50-ft no disturb zone
·       Install a small wall (16”) with (e.g. railroad ties) at the 38’ contour line where the proposed driveway ends and put a couple of feet of crushed stone and then a grassed area before the wall.
·       Install splash guards at the bottom of all downspouts.
·       The far corner of the driveway proposed shall be brought out of the 50-ft. no disturb zone.
·       Hay bales and siltation fence shall be installed in the area shown on the approved plan and the siltation fence shall be tucked under the double-staked row of hay bales.

2.  A Determination of Applicability for a proposed swimming pool at 76 Olde Forge Rd. in Hanover abutting Hanson (Map 115, Lot 4-1), owners Luciano & Tracy DiPietro with special conditions:
·       Silt Fence shall be installed on property as shown in approved plans.
·       A call to the Hanson Conservation Commission shall be made once the silt fence is installed for a site inspection.  781-294-4119, Ext. 118


Old Business/New Business

Agent’s hours signed

Mr. Bud Doolittle asked that $10,080 be release from his bond for construction of an existing retaining wall on Lot 1 of Bonney Hill Lane (DEP #175-357).  The Board postponed this to have a Formal Meeting with Mr. Doolittle on July 8th    at 9:15 PM to confirm the following:

Motion to release $10,000 to Mr. Doolittle if he finishes work on the Road, the outlet structure is required to have rebar on the top and on the side, and after we inspect:  Mr. Grattan

The Board voted to release an insurance bond for 788 Pleasant St. (Map 8, Lot 8A) to Vautrinot Land Surveying. DEP #175-380 as a Certificate of Compliance has been issued for installation of a septic system.
